ADVERTISING/SPONSORSHIP POLICIES
CONTENT: The banners and/or sites linked to familyfriendlyamerica.com/kidseatfreeplaces.com must comply with all federal and state regulations and can not contain material that is libelous, obscene or offensive. ACE Design Studio has final authorization to approve or deny all banners.
SPACE: The space contracted for shall be used exclusively for specified sponsorship link and shall not be sold or transferred in any manner without written consent of ACE Design Studio.
PLACEMENT: Banners will be placed on BOTH familyfriendlyamerica.com and kidseatfreeplaces.com pages that you purchase and can be linked to a URL of your choice.
For enhanced ads: The text information will be increased one font size from standard, we will link to your website, listing will be highlighted, and all text will be bolded. Additionally, up to 25 words may be added to your listing on each site.
Enhanced ad addon: A 234x60pixel banner will be placed immediately above each of your restaurant listings in one state.
State Sponsorships: A 468x60 pixel banner will be placed near the top of your selected state page on each site. Each of your locations in that state will also get an enhanced listing.
Only 1(ONE) of these is available per state.
Front Page Sponsorships: A 125x125 pixel banner will be placed near the bottom of the index page of each site.
TAXES: In the unlikely event that any tax is imposed on Internet links, the sponsor agrees to the addition of said taxes to the contracted fees with thirty days written notice from ACE Design Studio.
LIABILITY: The sponsor agrees to indemnify and save harmless ACE Design Studio against any and all loss, damage, cost and expense which ACE Design Studio may incur or become liable for by reasons of any and all claims or actions for libel, violation of privacy rights, plagiarism, copyright infringement, and any claim arising from banners placed on ACE Design Studio designed web pages for which a sponsor has approved a banner proof.
WARRANTIES: ACE Design Studio, its licensors, employees, or associates do not warrant either the results to be obtained from the service or that ACE Design Studio’s performance will be uninterrupted or error free. ACE Design Studio’s services are provided without warranties of any kind either express or implied. Neither ACE Design Studio nor anyone involved in creating or delivering ACE Design Studio services shall be liable for any direct, indirect, incidental, special or consequential damages arising out of the use of ACE Design Studio or the inability to use militarybaseinfo.com to link to the sponsor’s web site.
INTELLECTUAL PROPERTY: All artwork submitted by the sponsor shall remain the intellectual property of the sponsor and the sponsor warrants that they have full ownership rights and appropriate licenses to the material submitted to ACE Design Studio for placement on its web site. The sponsor is solely responsible for any actions to protect ownership rights for the artwork submitted to ACE Design Studio for placement on its web site. All banners created by ACE Design Studio are their intellectual property and remain so unless sponsor purchases rights.
RATE INCREASES AND CANCELLATIONS: All rate increases and contract cancellations will be with thirty days written notice. Either party, without notice, may terminate a contract should a documented breach of contract occur. Should a sponsor fail to fulfill the terms of their contract the sponsor shall pay for the site space used up until time of breach of contract.
PAYMENT: Payment is due in full prior to placement of any enhanced, state, or national ads. Renewal payments shall be made on a timely basis as billed by ACE Design Studio. Any payment which is 15 days late will be removed until paid or other arrangements have been made. Upon receipt of payment, banner will be replaced.
RETURNED CHECK FEES: ACE Design Studio will only accept company checks. Checks returned for non-payment will incur a $30 processing fee. Until fee and balance due is paid ACE Design Studio reserves the right to remove banner from its site. If more than one check is returned for insufficient funds (non-payment) then all future payments must be made by money order or credit card.
LITIGATION: Should an issue arise, sponsor agrees to pursue mediation with a mediator mutually agreeable to sponsor and ACE Design Studio. All contracts entered into with ACE Design Studio, regardless of state of origin, will be mediated or governed and litigated in and in accordance with the laws of Weld County, Colorado.
CORRECTIONS & CHANGES: (Banners designed by ACE Design Studio) Sponsors will receive a banner proof to review for accuracy and content. ACE Design Studio agrees to make two minor revisions of content before any banners are posted to the site. After the two revisions, or the posting of the banner, all changes will be charged at the rate of $50 per hour. ACE Design Studio’s only liability in the unlikely event of an error is correction of the error.
DEPOSIT AND REFUNDS: All sponsorship contracts are to be paid in advance for the term specified. (Banners designed by ACE Design Studio) Work on a banner can not begin without a 50% deposit. Sponsor reserves the right to cancel this contract within 48 hours of signing and receive a full refund. After 48 hours no refunds will be issued.
COMPLETION DATE: The posting of the banner(s) is promised within two weeks of receiving all necessary client provided information/graphics and proof is approved by the client. Should the banner(s) not appear on the site of the date specified the sponsor will receive a 10% discount unless the delay was caused by actions of sponsor.
